I often deal with fatal accidents as a pedestrian accident attorney, but this loss is especially disheartening. Fridaya week ago, at approximately 7:40am, the Milpitas Police Department responded to a traffic accident involving a vehicle and two pedestrians, near the St. John the Baptist Catholic Church, on South Abel Street and Junipero Drive.

 

The two pedestrians, a 67 year old woman and 75 year old man, were attendees of the church, leaving from a recent service, when they were struck by a motorist, and sustaining serious injuries.

 

Both pedestrians were transported to a local hospital, where the man unfortunately died from his injuries.

 

The driver, a 31 year old Milpitas resident, was not injured. Although the investigation is ongoing, alcohol was not deemed a factor in this collision.

 

It is always terrible to hear of a pedestrian death due to a traffic collision, but it is especially so when the storyinvolves the elderly, and that much more when it surrounds something as innocent as attending church services. Although I don’t yet know the cause of the accident, or information surrounding the death, I am hoping that the Milpitas police provide us with more information so that we can learn how this pedestrian fatality occurred and how it could have been avoided. As this is an ongoing investigation the Milpitas police is asking for the public’s assitance with any information as to the circumstances surrounding, or eyewitnesses to, the accident.
